This End User License Agreement (the "Agreement") is a legal agreement between you and UnMark governing your use of the UnMark mobile application (the "App") and its related subscription services. By downloading, installing, or using the App, you agree to be bound by this Agreement. This Agreement supplements, and does not replace, our Terms of Service and Privacy Policy.
UnMark grants you a limited, non-exclusive, non-transferable, revocable license to download and install the App on devices you own or control and to use its features for your personal, non-commercial purposes. The App is licensed, not sold, to you, and no ownership interest in the App is transferred under this Agreement. You may not: use the App for any unlawful purpose; reverse engineer, decompile, or disassemble the App (except to the extent expressly permitted by applicable law); copy, modify, rent, lease, sell, sublicense, or distribute the App; or remove any proprietary notices from the App.
The full functionality of the App, including unlimited video watermark removal processing, is provided through paid subscriptions available on a weekly, monthly, and annual basis. Subscriptions are billed through the app store on your device (Apple App Store or Google Play), and charges are applied to your app store account upon confirmation of purchase. All paid subscriptions renew automatically: unless you cancel at least 24 hours before the end of the current billing period, your subscription will renew at the then-current price, and the renewal charge will be applied to your account within 24 hours before the end of the current period. Subscription prices may change due to applicable taxes or app store policy adjustments, and any price change will be disclosed to you before renewal.
You may cancel your subscription at any time. After cancellation, you may continue to use the paid features until the end of the current billing period, after which your subscription will not renew and the App will revert to the free tier. To manage or cancel your subscription, go to your device's app store account settings: on iOS, open Settings, tap your name, then tap Subscriptions; on Android, open the Google Play Store, tap your profile, then Payments & subscriptions, then Subscriptions. Refund requests for subscriptions purchased through an app store must be submitted in accordance with the refund policy of the applicable store. If you do not cancel before the end of the billing period, you are deemed to have agreed to renew on the then-current terms.
The App allows you to upload and process your own video content. You retain all rights in the content you upload, and you represent and warrant that: (a) you own or have the necessary rights, licenses, and permissions to the material you upload; (b) any content you upload or process does not infringe any third party's copyright, trademark, privacy rights, or other legal rights; and (c) you will not use the App to process unauthorized, unlawful, or infringing content. Your use of the App to remove watermarks or other markers must be limited to content in which you hold the corresponding rights. You are solely responsible for your use of user content and its consequences, and you shall indemnify UnMark against any claims, losses, or damages arising from your breach of this section.
The App, including its design, code, interface, branding, documentation, and all related content, is owned by UnMark or its licensors and is protected by copyright, trademark, and other laws. All rights not expressly granted under this Agreement are reserved by UnMark. The name "UnMark", the logo, and all related names, logos, and product and service names are trademarks of UnMark and may not be used without prior written permission. Output files you generate using the App (processed video files) belong to you, but UnMark makes no representation or warranty as to the legality, accuracy, or suitability of any output content.
To the maximum extent permitted by applicable law, the App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted operation, or freedom from errors. UnMark does not warrant that processing results will meet any particular quality standard; output quality may vary depending on factors such as the resolution, encoding, and the type and complexity of the watermark in the original video. UnMark does not warrant that the App will operate without defects, without interruption, or that errors will be corrected in a timely manner. You understand and agree that your use of the App is at your sole risk.
To the maximum extent permitted by applicable law, in no event shall UnMark or its affiliates, officers, directors, employees, or agents be liable to you for any indirect, incidental, special, punitive, or consequential damages, including loss of profits, loss of data, or loss of goodwill, even if UnMark has been advised of the possibility of such damages. In no event shall UnMark's total aggregate liability to you under this Agreement exceed the amount you actually paid for the subscription in the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain implied warranties or of certain damages, so some of the above limitations may not apply to you.
This Agreement remains in effect between you and UnMark until terminated as provided in this section. If you breach any provision of this Agreement, UnMark may terminate this Agreement and revoke the license granted to you immediately without prior notice. You may also terminate this Agreement at any time by ceasing to use the App and deleting it. Upon termination: (a) all licenses granted to you terminate immediately, and you must stop using the App and delete it from your devices; and (b) Sections 4 (User Content and Responsibility), 5 (Intellectual Property), 6 (Disclaimer of Warranties), 7 (Limitation of Liability), 8 (Termination), and 9 (Contact) survive termination. Terminating this Agreement does not automatically cancel your app store subscription; to stop being charged, cancel your subscription as described in Section 3.
