UnMark respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we have adopted the following policy toward copyright infringement. This policy is incorporated by reference into our Terms of Service.
UnMark operates as an online service provider under the DMCA safe harbor provisions of 17 U.S.C. § 512(c). As a video processing tool, UnMark does not host, publish, or distribute user content to the public. However, to the extent that user-uploaded content is temporarily stored on our servers during processing, we comply with the DMCA's notice-and-takedown procedures as described below.
Pursuant to 17 U.S.C. § 512(c)(2), UnMark has designated a copyright agent to receive notifications of claimed infringement. All DMCA notices must be sent to: DMCA Agent, UnMark, Email: dmca@mail.unmarkvideo.com. Please include "DMCA Notice" in the subject line. Our designated agent is registered with the U.S. Copyright Office. Any notice that does not comply with the requirements of § 512(c)(3) may not receive a response.
If you believe that your copyrighted work has been infringed through our Service, your written notification must include substantially the following, as required by 17 U.S.C. § 512(c)(3): (a) A physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (b) Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered by a single notice; (c) Identification of the material that is claimed to be infringing, with information reasonably sufficient to permit us to locate the material; (d) Your contact information, including your address, telephone number, and email address; (e) A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; (f) A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. Please be aware that under 17 U.S.C. § 512(f), you may be liable for damages (including costs and attorneys' fees) if you knowingly materially misrepresent that material or activity is infringing.
If you believe that content you uploaded was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our DMCA Agent containing: (a) Your physical or electronic signature; (b) Identification of the material that has been removed or disabled and the location where it appeared before removal; (c) A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification; (d) Your name, address, and telephone number; (e) A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which UnMark may be found; (f) A statement that you will accept service of process from the person who provided the original notification. Upon receipt of a valid counter-notification, we will forward it to the original complaining party and may restore the removed material within 10 to 14 business days unless the complaining party files a court action.
In accordance with the DMCA and other applicable laws, UnMark has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. A "repeat infringer" is a user who has received two or more valid DMCA takedown notices within a rolling 12-month period. UnMark reserves the right to terminate a user's account after a single egregious violation, at our sole discretion. We also reserve the right to remove or disable access to any allegedly infringing material without prior notice and without liability to the user who uploaded the material.
UnMark provides video processing services, including watermark removal. Users are solely responsible for ensuring they have all necessary rights, licenses, and permissions to process, modify, and use any content uploaded to our platform. Using our Service to remove watermarks from copyrighted content without authorization may constitute copyright infringement. UnMark does not claim any ownership interest in the content you upload or the output generated by our Service. By using our Service, you represent and warrant that you own or have the necessary licenses to all content you upload, in accordance with Section 13 (DMCA Copyright Policy) of our Terms of Service.
This DMCA Copyright Policy supplements and is incorporated by reference into our Terms of Service. In the event of any inconsistency between this policy and the Terms of Service regarding DMCA procedures, this policy shall govern. For matters not specifically addressed in this policy regarding copyright and intellectual property, the provisions of Section 13 (DMCA Copyright Policy) and Section 12 (Termination and Suspension) of our Terms of Service shall apply.
